In consideration of ITServe Alliance allowing me to visit and participate in activities at Indian Trails Ranch and Resort at Farmersville, TX, I hereby take action for myself, my personal representatives, heirs, successors and assigns, and I hereby freely agree to and make the following contractual representations and agreements.
I fully realize the risks, injuries of participating in all activities by ITSERVE ALLIANCE at Indian Trails Ranch and Resort and fully assume the risks associated with such participation including, by way of example and not limitations, the following: the dangers of collisions with pedestrians, livestock, wildlife, vehicles, other bicyclist, fixed or moving objects; the dangers arising from surface hazards, equipment failure, inadequate safety equipment and weather conditions; the danger of contact with biting insects, reptiles and mammals; the dangers of participating in any water or play activity including drowning; and the possibility of serious physical and/or mental trauma including death.
I understand that I may be injured or may injure someone else while participating. I agree that ITServe Alliance is not responsible for the conduct of other persons or of the conditions of Ranch.
I release and waive any and all claims or actions which are in any way connected to or arise from my participation against ITServe Alliance, its affiliates, subsidiaries, successors, or assigns, as well as its owners, directors, employees, or volunteers and their affiliates, subsidiaries, successors, or assigns.
I acknowledge that I am solely responsible for determining my suitability to participate. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating or else I agree to bear the cost of such injury or damage myself.
I agree that drinking alcohol may or may not inhibit my ability to perform activities that require coordination, balance and control. If I choose to drink alcohol, I am solely responsible for monitoring the amount I consume and that I agree not to consume alcohol in excess of my ability to perform the activities offered by ITServe Alliance.
I have no physical or mental condition which to my knowledge would endanger myself or others if I participate in this event, or would interfere with my ability to participate in activities at Indian Trails Ranch & Resort sponsored by ITServe Alliance.
This release and waiver expressly includes indemnification for any negligence. I have had sufficient opportunity to read this entire document. I have read and understand it and I voluntarily agree to be bound by its terms.
